Terms of Service for DriveDex

Please read these Terms of Service ("Terms") carefully before using the DriveDex mobile application (the "App"), operated by Aasim Nawaz Sheik ("we," "us," or "our"). By creating an account or using the App, you agree to be bound by these Terms and by our Privacy Policy.

1. Eligibility

You must be at least 16 years old to create an account and use the App. If you are under the age of majority in your jurisdiction (18 in Switzerland), you may only use the App with the involvement and consent of a parent or legal guardian. Participation in certain features, such as real-world Raffles (Section 6), strictly requires you to be at least 18 years old. By using the App, you represent that you meet these requirements.

2. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Choose a username that does not impersonate another person or infringe anyone else's rights; we may reclaim or reset usernames that violate these Terms. Notify us promptly at aasim.sheik.988@gmail.com if you suspect unauthorized use of your account.

3. Using the Camera and Scanning Feature

The App's core feature lets you photograph real-world vehicles to identify them and add them to your in-app garage collection. By using this feature, you agree that:

• You will only photograph vehicles and license plates that are visible from a public place or that you otherwise have the legal right to photograph, and you will comply with all applicable laws regarding photography, privacy (including Swiss revDSG), and trespassing.
• You will never use the camera feature while driving or operating a motor vehicle.
• You will not use the App to harass, stalk, or surveil any individual, or to capture images for any unlawful purpose.
• Scan results (make, model, year, estimated value, rarity tier) are generated by an AI vision system and are estimates only — see Section 8 (Disclaimers). They are not professional appraisals and must not be relied upon for insurance, financial, purchasing, or commercial decisions.

We reserve the right to remove any scanned vehicle, revoke points, or suspend accounts obtained through prohibited photography (e.g., entering private garages without permission) or attempts to game the AI verification system (e.g., scanning screen monitor photos or printed paper images).

4. User Content and License

"User Content" means vehicle scan photos, usernames, and any other media or text you submit through the App. You retain ownership of your User Content. By submitting it, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display it within the App — including showing your scanned vehicles in your public Garage, displaying your stats on Leaderboards, and processing images through third-party AI APIs (e.g., Gemini Vision) to determine car details.

You represent that you have all necessary rights to submit your User Content and that it does not infringe any third party's intellectual property or privacy rights.

5. Points, Badges, Scans, and Virtual Items

• Spotter Points, bonus scans, badges, streaks, and ranks ("Virtual Items") are earned through gameplay and have no real-world monetary value. They cannot be sold, transferred, traded, exchanged for real cash, or redeemed outside the App.
• We may adjust point values, rarity tiers, streak bonuses, badge requirements, or any other aspect of the in-app economy at any time, including retroactively in cases of detected abuse or software bugs.
• Watching a rewarded video ad to earn a bonus scan or raffle entry requires viewing the ad to completion; the reward is not guaranteed if the ad fails to load, is skipped, or is closed early.
• If we discontinue the App, Virtual Items will expire with no monetary value or refund.
• Any future in-app purchase options ("Buy Points") will be governed by platform-specific (Apple App Store / Google Play Store) payment policies.

6. Raffle / Sweepstakes

From time to time, the App may offer entries into a raffle or giveaway for real-world prizes (such as event tickets).

• Eligibility: Participation in Raffles is strictly limited to users aged 18 or older.
• No Purchase Necessary: Raffle entries earned via ad views or spent in-game Spotter Points carry no real-world monetary purchase requirement.
• Rules & Void Jurisdictions: Raffles are void where prohibited by law. Winners are responsible for any local taxes or customs fees associated with prize acceptance.

The App displays third-party advertisements, including rewarded video ads served via Google AdMob. We do not endorse or control third-party ad content, and your interactions with third-party advertisers are solely between you and the advertiser.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE SWISS LAW, Aasim Nawaz Sheik SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA ARISING OUT OF YOUR USE OF THE APP. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE APP SHALL NOT EXCEED CHF 50.00.

Nothing in these Terms limits liability for gross negligence, intentional misconduct, or personal injury where such limitation is unlawful under applicable law.

10. Termination and Account Deletion

• Self-Serve Account Deletion: You can permanently delete your account and all associated personal data at any time via the Delete Account option located in the footer of the Shop / Rewards screen in the App.
• Account Suspension: We reserve the right to suspend or terminate your account if we reasonably suspect fraudulent activity, cheating, harassment, or violation of these Terms.

11. Changes to Terms

We may update these Terms from time to time. If changes are material, we will notify you through an in-app notice prior to the effective date. Continued use of the App following updates constitutes acceptance of the modified Terms.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the substantive laws of Switzerland, excluding its conflict of law provisions. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Zurich, Switzerland.
